The Appeals Court Cleared the Pied-à-Terre Rollout. Plan on the January Bill.

The Roebling Report · By Corey Cohen · Principal, The Roebling Team at Compass

Four judges, no dissent. On November 4 the Appellate Division reversed the Staten Island ruling that had ordered the city to redo its pied-à-terre surcharge rollout. The roll stands, the notices stand, and the first charges stay on the property tax bill due January 1, 2027.

What was decided

The case, O'Brien v. City of New York, never challenged the tax. It challenged the rollout: a public roll of roughly 900,000 properties, and notices that left owners to prove their apartment was a primary residence. On September 29 the trial court agreed and cancelled the notices. That ruling was stayed on appeal, so the rollout never stopped.

The appellate panel found no harm in either. Assessors publish similar lists as a matter of course, and receiving a notice is not an injury. Every taxpayer spends time complying with a tax.

What is still open

Two other suits argue the surcharge itself is unconstitutional because it taxes nonresidents who can't vote for the lawmakers who imposed it. Neither has a ruling. That argument asks a court to strike down a state tax. The one that just lost only asked the city to redo its process.

What it means by building

The exposure is concentrated. On the Department of Finance's July 24 supplemental roll, 144 of 179 apartments at Central Park Tower and 206 of 352 at the Towers of the Waldorf Astoria carry a market value above the $1 million line for condos and co-ops. The roll has no residency test, so those counts show where apartments cross the threshold, not who owes. But in buildings like these, most apartments are over the line, and any owner there who lives in the apartment full-time has to prove it.

What to do

  • Primary residence, flagged: the burden is yours, and the city won't check for you. Keep the file complete: returns, voter registration, license. If you missed the exemption window, the Tax Commission route runs to March 1, 2027 for condos and co-ops and March 15, 2027 for houses.
  • True pied-à-terre: budget it on the January bill. Co-op owners should ask the managing agent now how the board will pass it through.
  • Buying or selling: price it as a recurring cost. It is calculated from the Department of Finance value, not the sale price.

The read

In August I wrote that the likeliest outcome was a cleaner rollout, not a repeal. The court didn't even require cleaner. Underwrite the surcharge as a permanent cost of a second home in New York; the constitutional cases are upside, not the base case.

Run the number for a specific apartment with the Pied-à-Terre Tax Calculator, or read the pied-à-terre tax, explained for the brackets, exemptions and appeal routes. Whether to hold, rent or sell into it turns on the after-tax carry of the specific apartment, which is the analysis we run for clients.
