Town of Jackson vs. Teton County

The municipal boundary is one of the most consequential invisible lines in Jackson Hole. It decides which zoning map, permit office, development code and review programs apply. The comprehensive plan is joint; the entitlement path is not.

Resolve jurisdiction before reading zoning

A Jackson postal address does not resolve jurisdiction. The County's planning guidance directs owners to confirm whether a property lies inside the Town limit before applying County rules. The current municipal boundary and parcel record should therefore be the first map intersection in any acquisition or development brief.

Once resolved, the systems stay separate. Town zoning and overlays should not be used to describe County land, and County natural-resource procedures should not be quoted as Town entitlement rules. The joint comprehensive plan supplies shared policy context without merging the codes.

Town concentrates design and use questions

Town property requires a close reading of municipal zoning, design overlays, historic status, parking, use and the Lodging Overlay. The Town's 2021 historic-preservation program can add a distinct review path for listed structures. Rental authority depends on current overlay and permit status as well as private documents.

The compact setting can also make existing nonconformities, access, shared improvements and prior approvals especially important. A successful neighboring project is evidence of context, not a transferable entitlement.

County land foregrounds site systems

Unincorporated County review often begins with the physical land system: zoning and site-development allowance, natural-resource tier, waterbody buffers, scenic standards, slope, flood, wildfire, access, water and wastewater. The tiered Natural Resources Overlay applicable since 2025 makes property-specific habitat review part of the early development question.

Subdivision and planned-unit-development approvals can also carry property-specific conditions that are not obvious from the base zone. Retrieve the governing approval rather than assuming the current code is the whole rule.

Private rules survive both systems

Public permission does not override a declaration, covenant or easement, and private consent does not supply a public permit. The two layers should be read together and the more restrictive operative rule identified for the proposed use.

This is particularly important for rental, expansion, accessory uses, fences, roads, signs and resort amenities. The correct answer is attached to the property and proposal, not the market label.
