37 Walton Street is a seven-story, 24-residence condominium at the corner of Walton Street and Marcy Avenue in South Williamsburg. The offering plan filed with the Attorney General was accepted for filing on September 3, 2026, and the sponsor amended it on September 23.

The address needs care. The plan uses 37 Walton Street. City property data (PLUTO) lists the lot as 415 Marcy Avenue, the Department of Buildings carries it at 427 Marcy Avenue, and published construction reporting covers it as 427 Marcy Avenue. The two are tied together on three points: the plan's sponsor entity, 33 Walton Holdings LLC, is the owner of record of that lot in PLUTO; the plan's 24 residential units and one commercial unit match the 24 residential units and 26 total in PLUTO and the 25 units in the reporting; and construction reporting places the residential entrance on Walton Street.

For a buyer, the building is a small new-construction condominium with 24 homes, balconies and enclosed parking.

Architecture and residences

Published construction reporting from May 2025 describes a seven-story, ground-up reinforced-concrete building of about 79,200 square feet designed by Diego Aguilera Architects, with a gray brick facade, a grid of large windows, balconies with metal railings, setbacks at the upper corners, commercial frontage on Marcy Avenue and a residential entrance on Walton Street next to a garage door for enclosed parking. It was then expected to complete in summer 2025. PLUTO carries a 2019 year built, which does not fit that reporting, and 60,720 square feet of building area. The lot is zoned R7A with a commercial overlay.

The stories and floor area above come from PLUTO and the reporting rather than a Department of Buildings new-building filing. Unit mix, sizes and finishes are in the plan's schedules.

Offering and pricing

Per the offering plan filed with the New York State Attorney General (plan CD260081), the plan was submitted March 5, 2026 and accepted for filing September 3, 2026 at a total offering price of $51,537,000 for 24 residential units and 1 commercial unit. Amendment 1, submitted September 23, 2026, was pending review on the Attorney General record. The record shows no effective date and no units sold.

What to know if you’re buying

Deposit and contract. Sponsor contracts typically require a deposit of 10 percent or more at signing, held in escrow, with the balance at closing. Because the plan was not yet effective on the Attorney General record, the sponsor cannot close until it is declared effective, which requires contracts on a minimum share of units.

Transfer taxes and the mansion tax. In sponsor sales the buyer customarily pays the New York State and New York City transfer taxes. The state mansion tax of 1 percent applies at $1 million and above, with higher rates at higher prices.

Closing on a temporary certificate of occupancy. Sponsors in New York commonly close on a temporary certificate of occupancy, renewed in short terms until the building receives a permanent one. Construction was reported nearly complete in May 2025, so ask for the current certificate status and for how long the building has been finished.

Common charges, taxes and the board. The plan's budget projects first-year common charges and real estate taxes, and the sponsor controls the board until owners take control on the plan's schedule. The plan's tax disclosure states whether an abatement applies.

Building-specific points. Read the budget's assumptions and the first year of operation it covers, since construction was reported nearly complete well before the plan was accepted. The commercial unit shares the declaration with the residences. Ask what the September 2026 amendment changes.
