What to know if you’re buying
Reservations before plan acceptance are non-binding. A reservation holds a place in line, and the sponsor can change terms until the plan is accepted.
The plan must be accepted before contracts. Until the Attorney General accepts the plan, the sponsor cannot sign binding purchase agreements. Once accepted, the plan's price schedule sets each unit's price.
Deposits are held in escrow. Sponsor deposits typically run 10 to 20 percent of the price, held in escrow until closing.
The buyer customarily pays transfer taxes. In sponsor sales the buyer pays New York State and New York City transfer taxes, and the mansion tax applies at $1 million and above, rising in tiers from $2 million.
Closings take place on a temporary certificate of occupancy. For a conversion, the new certificate of occupancy is issued under the Article 7B filing. A temporary certificate of occupancy (TCO) lets residents move in while final sign-offs are pending.
Budget, common charges and any abatement are set in the plan. With six units, each owner carries a large share of building expenses. No abatement has been announced.
Conversion-specific points. The DOB filing shows seven stories against the six-story garage in PLUTO, so ask whether the plan includes a rooftop addition. Ask for the engineering reports on the garage's concrete slabs, which were the subject of repair filings in 2023 and 2024.
